Terms of use

These terms of use ("Terms") are an agreement between you and TripToPahar. They apply when you use triptopahar.com, the TripToPahar app, the TripToPahar Host app and the host dashboard (together, the "Service"), whether you are a traveler looking for a stay or a host listing a homestay.

By using the Service, creating an account or listing a homestay, you agree to these Terms, our Privacy policy and our Refund and cancellation policy. If you do not agree, please do not use the Service. These Terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.

1. Who we are

TripToPahar is a sole proprietorship owned and operated by Deep Saha, Ghogomali, Siliguri, West Bengal 734006, India. In these Terms, "TripToPahar", "we", "us" and "our" mean that business. "You" means the person using the Service. A "traveler" is someone who looks for or contacts a homestay, and a "host" is someone who lists or manages a homestay on TripToPahar.

2. What TripToPahar is, and what it is not

TripToPahar is an online directory of homestays in the Himalaya and North Bengal, including Darjeeling, Kalimpong, Sikkim and the Dooars. It helps travelers find homestays and contact their hosts by phone, WhatsApp or an inquiry form.

  • We do not own, run, manage or inspect the homestays listed, and we are not a travel agent, tour operator or booking agent.
  • We do not take bookings and we do not collect any payment for a stay. Travelers book and pay hosts directly.
  • Any agreement about rooms, dates, price, advance payment, cancellation and refund of a stay is made between the traveler and the host. TripToPahar is not a party to it.
  • Travelers use TripToPahar for free. Hosts can list for free and can choose a paid plan for extra features (see “For hosts: paid plans”).

For content that travelers and hosts post, TripToPahar acts as an intermediary under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

3. Who can use TripToPahar

You may browse TripToPahar without an account. To create an account, send an inquiry, write a review or list a homestay, you must be at least 18 years old and able to enter into a binding contract under Indian law. If you use the Service for a business, you confirm that you are allowed to accept these Terms for it.

4. Your account

  • You can sign up with your email address and a password, or with Google or Apple. Give accurate details and keep them up to date.
  • Keep your password private. You are responsible for everything done through your account. Tell us at once if you think someone else is using it.
  • One person, one account. Do not create accounts for someone else without their permission, or create accounts to get around a suspension.
  • You can delete your account at any time from account settings in the app, on the website or on the host dashboard.

5. Rules for using TripToPahar

You must not host, display, upload, publish, share or send any information on TripToPahar that:

  • belongs to someone else and you have no right to use;
  • is obscene, pornographic, paedophilic, invasive of another person's privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, or encourages money laundering or gambling;
  • is harmful to children;
  • infringes any patent, trademark, copyright or other proprietary right;
  • deceives or misleads about where a message came from, or knowingly shares false or misleading information;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states or public order, incites any offence, or insults any other nation;
  • contains software viruses or any code designed to interrupt, destroy or limit any computer resource;
  • is patently false and untrue and written to mislead or harass a person, entity or agency for financial gain or to cause injury; or
  • breaks any law in force.

You also must not scrape or copy listings or contact details in bulk, use host or traveler contact details for anything other than the stay you asked about, send spam or fake inquiries, try to break into or overload the Service, or get around plan limits or security features.

We may remove content and suspend or close accounts that break these rules, and report them to the authorities where the law requires. Content removed on an order from a court or government agency is taken down within 36 hours.

6. Reviews, photos and other content you post

  • Reviews must describe your own genuine stay at, or contact with, the homestay. Do not post reviews that are false, abusive, paid for or rewarded, or about a homestay you own, work for or compete with.
  • Only upload photos you took or have the right to use, and do not upload photos that show other people without their permission.
  • You keep ownership of what you post. You give TripToPahar a non-exclusive, royalty-free, worldwide licence to host, show, resize, translate and share it on the Service and in promoting TripToPahar, for as long as it is on the Service.
  • We may check, hold, hide or remove reviews and other content that break these Terms. Hosts can reply to reviews publicly. Removing content does not mean we agree or disagree with it.

7. Listings and the Verified label

Hosts write and update their own listings, including photos, rooms, prices, amenities and house rules. Our team reviews new listings before they appear in search, but we cannot check every detail and we do not guarantee that a listing is accurate, complete or current.

Some listings were created by TripToPahar from public sources, such as OpenStreetMap and other openly published business directories, so travelers can find homestays that have not joined yet. These listings show the homestay's publicly available business name, location and contact numbers, are marked as not yet claimed by the host, and are not verified. The owner can claim, correct or ask us to remove such a listing at any time (see “For hosts: claiming a listing and verification”).

A Verified label means our team checked the documents the host gave us at the time we checked them. It is not a guarantee of the homestay, the host, its safety or the stay.

8. How homestays are ranked

Search results and destination pages are ordered using factors such as how well a homestay matches your search and location, its reviews and rating, how complete and up to date the listing is, how quickly the host responds, verification, and the host's plan. Hosts on Plus and Premium plans get a ranking boost and a plan badge. Premium homestays may also appear in featured places on destination pages, and featured places are labelled as such.

9. For travelers: contacting hosts and booking direct

  • When you tap Call, WhatsApp or send the inquiry form, we record the inquiry so the host can follow it up and so we can measure and rank listings fairly. The inquiry form passes your name, phone number, email, dates, number of guests and message to that host.
  • Before you pay anything, confirm the room, dates, price, what is included and the host's cancellation and refund terms with the host directly. Prefer paying on arrival, or a small advance by a traceable method. Never share OTPs, card PINs or passwords with anyone.
  • Payments you make to a host, and any refund of them, are between you and the host. TripToPahar cannot refund money you paid a host. Our Refund and cancellation policy explains what to do if a stay goes wrong.
  • If a listing is wrong, closed or looks fraudulent, report it from its page or contact us, and we will look into it.

10. For hosts: listing your homestay

  • Only list a property you own, run or have written permission to list. Do not use another person's name, photos or documents.
  • You are responsible for everything on your listing. Keep it accurate and up to date, including availability, prices, taxes and charges, house rules and your cancellation and refund policy.
  • You are responsible for complying with the law that applies to your homestay, including any registration with the state tourism department, local permissions, fire and safety rules, guest registration (for example Form C for foreign guests) and your own taxes.
  • Your homestay's name, photos, description, rooms, prices, amenities, policies, location, booking phone and WhatsApp numbers, host name and bio, rating and reviews are shown publicly so travelers can contact you. By listing, you agree to this.
  • You give TripToPahar a licence to show, resize and share your listing content on the Service and to promote TripToPahar, as described in “Reviews, photos and other content you post”.

11. For hosts: claiming a listing and verification

If your homestay is already listed, you can claim it from the host dashboard or the TripToPahar Host app by uploading proof that you own or run it. To get the Verified label, you may be asked for identity proof (such as Aadhaar, PAN or a driving licence; you may mask all but the last four digits of an Aadhaar number), proof of address or property registration, and proof of your phone number and location.

Verification documents are seen only by the TripToPahar team, are never shown to travelers, and are handled as our Privacy policy describes. We may refuse a claim or verification, or remove the label later, if documents are unclear or appear not to be genuine.

12. For hosts: inquiries and travelers

  • Use a traveler's contact details only to answer their inquiry and arrange their stay. Do not add them to marketing lists or share them.
  • Treat travelers fairly, honour the prices and policies you publish, and tell travelers clearly about any advance, cancellation charges and refund terms before they pay you.
  • Do not offer rewards for reviews, write reviews of your own homestay or pressure a traveler to change or remove a review.
  • If an inquiry is spam or a wrong number, you can report it from your inquiries within 30 days.

13. For hosts: paid plans

Listing a homestay on TripToPahar is free. Hosts can buy a Plus or Premium plan, monthly or yearly, for features such as unlimited inquiries with traveler details, a WhatsApp button, analytics, more photos, a plan badge, a ranking boost, featured placement and priority support. The features and prices of each plan are shown on the plan page before you buy.

  • Prices are in Indian rupees and include GST. On the host dashboard you pay through Razorpay by card or UPI Autopay, and we email a GST invoice for each payment. In the TripToPahar Host app you pay through the App Store or Google Play, which bill you and send their own receipts.
  • Plans renew automatically at the end of each month or year until you cancel. Cancelling stops the next renewal, and you keep the plan until the end of the period you have paid for.
  • If a renewal payment fails, your plan keeps working for a short grace period (3 days for payments on the dashboard). If payment still fails, your homestay moves to the Free plan; your listing stays live.
  • We may change plan prices or features. We will tell you at least 30 days before a price change applies to your plan, and you can cancel before it does.
  • Payments are non-refundable except as set out in our Refund and cancellation policy.

A paid plan improves how your listing is shown. It does not guarantee any number of inquiries, bookings or a particular ranking.

14. Third-party services

The Service uses and links to services run by others, such as Google and Apple sign-in, WhatsApp, maps from OpenStreetMap, Razorpay, the App Store and Google Play. Your use of them is governed by their own terms and privacy policies, and we are not responsible for them.

15. Our intellectual property

The TripToPahar name, logo, design, software, text and our travel guides belong to TripToPahar or its licensors. You may use the Service for your personal, non-commercial use, or as a host to manage your listing. You may not copy, sell, reverse-engineer or build a competing directory from it. Map data is © OpenStreetMap contributors.

16. Suspension and closing accounts

We may warn you, limit features, hide or remove content or listings, or suspend or close your account if you break these Terms or the law, if we receive repeated genuine complaints, if we suspect fraud, or if we must do so by law. Where it is reasonable and allowed, we will tell you why and give you a chance to respond. If a host's account or listing is closed for breaking these Terms, unused plan time is not refunded.

You can stop using the Service and delete your account at any time. Deleting a host account removes the homestay from search and stops any plan bought on the dashboard from renewing. Store subscriptions must be cancelled in the App Store or Google Play.

17. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no promise that it will be uninterrupted, error-free or always available, or that listings, prices, reviews, travel guides, weather, road or permit information are accurate or current. Travel in hill and border areas can involve risks such as landslides, road closures and permit rules; check conditions and permits with the authorities before you travel.

18. Limitation of liability

To the extent the law allows, TripToPahar is not liable for: the stays, services, conduct, safety, prices or cancellations of hosts or travelers; money paid between travelers and hosts; disputes between them; loss of bookings, business or profit; or any indirect or consequential loss.

To the extent the law allows, our total liability to you for any claim about the Service is limited to the amount you paid TripToPahar in the 12 months before the claim, or ₹1,000 if you paid us nothing. Nothing in these Terms limits liability that cannot be limited by law.

19. Indemnity

You agree to compensate TripToPahar for losses, claims and reasonable costs, including legal fees, that arise because you broke these Terms or the law, or because of content you posted or, as a host, a stay you provided.

20. Complaints and Grievance Officer

If you have a complaint about TripToPahar, a listing, a review, other content or how we handle your personal data, contact our Grievance Officer:

We acknowledge every complaint within 24 hours and resolve it within 15 days of receiving it. Requests to remove content that exposes a person's private parts, shows them in a sexual act or impersonates them are acted on within 24 hours. Please include your name, contact details, the link to the listing or content concerned and what you would like us to do.

21. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first so we can try to resolve any dispute informally. If it cannot be resolved, the courts at Siliguri, Darjeeling district, West Bengal have exclusive jurisdiction, subject to any right you have under the Consumer Protection Act, 2019 to approach a consumer commission.

22. Changes to these Terms

We may update these Terms as the Service or the law changes. The date at the top shows the latest version. If a change materially affects you, we will tell you on the website, in the app or by email before it takes effect. If you keep using the Service after that, you accept the updated Terms.

If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we do not give it up.
